Title: Domestic violence and its prevention Abstract The purpose of my thesis is to analyze the issues of domestic violence, outline the basic characteristics of its essential aspects and focus on preventive measures of protection against domestic violence, especially the applicable legislation of the Czech Republic. The paper is divided into four chapters. The first chapter contains the characteristics of domestic violence as a criminological concept. At first there is a definition of the phenomenon of violence as the intentional act involved in the maltreatment and abuse. The second subchapter presents actual domestic violence which is explained by a description of its elements, types and forms, its process, method of identifying and documenting its causes. Chapter One concludes with a part regarding myths prevailing in the society about domestic violence. The following chapter focuses on violent persons and endangered individuals by domestic violence. The aim of this chapter is to describe the profile of both actors regardless of the gender expectations. Subchapter relating to endangered individuals includes the definition of victim and further discusses long term psychological consequences of abuse and specific groups of endangered individuals. - Criminal-law protection of victim of domestic violence The aim of the thesis is to summarize and evaluate the issue of legal protection of domestic violence victims in the Czech Republic, especially what concerns criminal law. In the first part of the thesis, the author deals with the definition of domestic violence and issues associated with it. Attention is paid to the features which must be present so that violent behaviour may be considered domestic violence. The work also mentions the types and causes of domestic violence, as well as myths that are rooted about it in society. In addition, this chapter also focuses on the characterization of the perpetrators and victims of domestic violence. The second chapter discusses the development of the society's attitude towards solutions of domestic violence. It focuses on the breaking point when society realized the need for changing its attitudes towards domestic violence. Particular parts of the chapter focus on the most important legislative milestones. At first, it discusses the introduction of the fact of crime of battering a person living in a shared house or flat into the Criminal Code. Criminological and criminal aspects of domestic violence

This rigorous thesis presents an undesirable social phenomenon - domestic violence, which can be considered one of the most widespread and most severe form of violence in our society. The aim of the rigorous thesis is, as the name itself suggests, to present as much comprehensive picture as possible of the issue of domestic violence in terms of its criminological and criminal law aspects, i.e. to summarize the current valid and effective criminal law regulation of this phenomenon, to point out its shortcomings and to suggest possible improvements according to conclusions. In addition to the introduction and conclusion, the rigorous thesis is divided into five chapters; the first one is dedicated to the definition of some basic terms that are directly related to the topic. In particular, the term of domestic violence, its characteristics, the causes, why this sociopathological phenomenon occurs, the forms and appearances in which it occurs, and the phases are described. Criminal Law and Criminological Aspects of Domestic Violence

The topic of the thesis is "Criminal Law and Criminological Aspects of Domestic Violence". The phenomenon of domestic violence transpires through the whole society; it is a socially-wide issue which has been present for a long period of time. Initially, domestic violence was considered to be a private problem not to be intervened by the state. However, in last 30 years this attitude has changed and the interception of domestic violence gone through a significant transformation. The society started to recognize this issue as a subject of a public concern which requires also state intervention. The complexity of domestic violence requires interdisciplinary approach. The first part of the thesis provides definition and general description of domestic violence. It describes elements of domestic violence (such as privateness, recurrence, long-term, inequality of the involved parties, escalation, etc.), its kinds and forms, rules and specifics which differentiates domestic violence from other types of violent conduct. Victims of Domestic Violence, Particularly Criminological and Criminal Law Aspects

The aim of the thesis was to summarize the issue of the victims of domestic violence in the Czech Republic, including the legal development of the recent years, concerning particularly the criminological aspects of the issue as well as the criminal law aspects. The opening part deals with defining concepts such as domestic violence, victims, aggressors, their personal psychological aspects and legal terms - endangered person ("ohrožená osoba") and violent person ("násilná osoba"). The second main section of the thesis pays attention to the legislation on the help and support given to the victims of domestic violence in the Czech Republic, not only dealing with the immediate help given by the police and the judiciary in the form of the order-out decision of the aggressors from the common home, but dealing with the longterm psychological and social support offered by the intervention centers as well. The third basic part of the work focuses on the criminal law aspects of the domestic violence phenomenon, particularly current practice of the courts and rights of the victims as the aggrieved parties in the criminal procedure.
